Ensuring personal data protection for LGBTIQA+ people in Brazil faces several regulatory inconsistencies. These include the failure to understand the scope of the concept of sexual life, the conception of gender identity, and its difference from sexual orientation. There are also questions about the inclusion of the concept of discrimination in light of personal data regulation and the possibility of understanding whether sensitive data corresponds to open or closed numbering. Starting from the premise of the recognition of a fundamental right to the protection of personal data, with an individual and trans individual facet, an objective, and subjective dimension, and through a hypothetical-deductive methodology with empirical jurisprudential research, this article aims to analyze the legal dogmatics of the fundamental right to the protection of personal data from the perspective of intersectionality and the rights of the LGBTIQA+ population. The preliminary conclusion is that an in extenso interpretation of different legal concepts on data protection is needed, consistent with constitutional and conventional jurisprudence. Likewise, based on constitutional legal dogmatics, elements are identified in the legal system that could strengthen the adequate, comprehensive, and spontaneous protection of the fundamental right of this portion of the population.
